for the use of the services of the Bödmen-Baad Ski School

(hereinafter: Bödmen-Baad Ski School)


1st General, Scope

Unless there is express agreement to the contrary, these General Terms and Conditions of Business (GTC) apply to all transactions between the Bödmen-Baad Ski School and persons, who make use of the services of the Bödmen-Baad Ski School (hereinafter: Customer). They also form the basis of all supplies and services from the Bödmen-Baad Ski School by virtue of online orders via the Internet or other online services.

The version of the GTC in force at the time of conclusion of the contract is always definitive.

The object of the company is the operation of a snow sports school (ski school). Encompassed therein are services, such as the delivery of instruction in the skills and knowledge of snow sports, in particular skiing, snowboarding and cross-country skiing (without any guarantee of specific success in training), together with the organisation and supervision of snow sports, in particular skiing, snow boarding and cross-country skiing.

Where reference is made in this contract to natural persons solely in the masculine form, this refers equally to women and men.

2nd Ordering and conclusion of the contract

Reservations for private lessons and group courses can be made via the Internet, by e-mail and/or the online form or by telephone. Reservations are not valid until confirmed in writing as a firm booking by the Bödmen-Baad Ski School.

Offers from the Bödmen-Baad Ski School are without obligation. Our written confirmations of order are solely definitive for acceptance of the reservation and the scope of the service. Collateral agreements made verbally or by telephone are valid only on express, written confirmation from the Bödmen-Baad Ski School.

In the case of conclusion of a contract  with the Bödmen-Baad Ski School  a contractual relationship is not established until payment of the required service has been made and the course card necessary thereto has been issued.
 

3rd Rates

All the Bödmen-Baad Ski School prices listed are in euros and unless otherwise agreed, deemed to include statutory value added tax. Price lists are supplied without guarantee. We do not assume liability for printing errors.

Use of the lift facilities is not included in the course fee.
 

4. Payment methods

For the payment of the services ordered through the online shop the customer is offered the following methods of payment:

  • Payment by credit card (Visa and Mastercard) 
  • Payment by direct debit (direct bank transfer)
  • Payment by means of iDeal

For the payment of the services required in the offices of the Bödmen-Baad Ski School the customer is offered the following methods of payment: 

  • Payment by credit card (Visa and Mastercard) 
  • Payment by EC Maestro card
  • Payment in cash

Credit card payments in favour of the Ski School are collected by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland (TREKKSOFT). TREKKSOFT appears as TREKKSOFT TOUR BOOKING on your credit card statement. The domain, in which you issue and edit your payment is the property of TREKKSOFT and is operated by TREKKSOFT. Please send an e-mail to support(at)payyo.ch for all enquiries on your credit card payments and cancellations.
 

5. General conditions of participation

If a group should be reduced to less than 4 participants for any reason, the Ski School Bödmen-Baad reserves the right to assign the participants to another group or to reduce the number of lessons.

Changes of instructors are possible due to our flexible organisation.

The allocation of groups to ski courses is conducted by the Bödmen-Baad Ski School. If it is necessary to assign the participant to a lower skill group during the course, the customer has to accept this decision. Otherwise, the Ski School Bödmen-Baad is entitled to termination of the contract.
 

6. Liability

The Bödmen-Baad Ski School does no accept any liability whatsoever for accidents, which occur during, prior to or subsequent to ski, snowboard or cross-country skiing tuition. It is the responsibility of course participants to take out accident and liability insurance.

The customer must inform the Bödmen-Baad Ski School truthfully and in full about his skills and experience. Similarly, the customer must inform the Bödmen-Baad Ski School in full about his health and any health problems.

The services provided by the Bödmen-Baad Ski School may at every skills level place high demands on the material and on the physical fitness and skiing technique of the participant. Every customer is therefore requested to ensure that he or the participants, for whom he has booked the course, particpates/participate in the services booked only with faultless, maintained sports equipment and the usually prescribed safety equipment. The participant's own performance capacity must be realistically assessed in this process.

The customer is notified that failure to wear a crash helmet may give grounds for contributory fault of the course participant, for which reason it is recommended that crash helmets and other safety equipment recommended for the service booked in each case are worn.
 

7. Withdrawal/ cancellation conditions

You can at any time cancel an online booking without giving reasons. No costs are incurred. Cancellation must be notified to the ski school in writing or by e-mail at the latest 3 days prior to the start of the course. Cancellation 1 - 2 days prior to the start of the course is possible only with a doctor's certificate. If a travel warning for our region is announced, cancellation at short notice is also possible. This negative booking applies also for online bookings of ski and snowboard material in our in-house ski rental. 

On start of private lessons and group courses a refund for payment already made, is possible only in the case of accident and illness, subject to the submission of the original receipt (course ticket) and with a doctor's certificate from a local doctor. Only unused days shall be refunded (remaining amounts).

Courses cancelled due to weather conditions (force majeure) or breakdowns of the cable car lift systems are not refunded.

Courses take place regardless of the weather conditions. The course ticket is not transferable, course days not used cease to apply.
 

8. Warranty

The Bödmen-Baad Ski School warrants to the customer that the service booked is consistent with the contract, without, however, guaranteeing to the customer any success.
 

9. Content of the Online Offer

The Ski School Bödmen-Baad (hereinafter "author") does not assume any liability for the correctness, completeness or quality of the information provided, nor does he guarantee that all the information is up-to-date. Liability claims against the author, concerning damage of idealistic or of a material kind, which was caused by the use or non-use of the presented information and/or by the use of incorrect and incomplete information, are in principle impossible, insofar as a non-deliberate or roughly negligent fault can be proved on the part of the author.

All offers are subject to change and are non-binding. The author expressly retains the right to amend, supplement, delete or discontinue the publication, temporarily or permanently, of parts of the pages or the entire offerings without special notice having been given.
 

10. References and Links

For direct or indirect references to third-party websites ("links"), which are not within the area of responsibility of the author, a liability obligation would come into force exclusively in the case, where the author has knowledge about the content and it is technically possible and reasonable to prevent the use of illegal content.

The author hereby expressly states that at the time of the setting of the links there was no illegal content recognizable with the linked pages. The author does not have any influence on the current and future organization, the contents or the authorship of the linked pages. Therefore, the author hereby expressly disassociates itself from all the contents of all linked/referenced pages, which were changed after the links had been set. This statement applies to all links and references, set within our own internet content as well as to foreign entries in guest books, panels and mailing lists installed by the author.

For illegal, faulty or incomplete contents and particularly for damage which results from the use or non-use of information presented the supplier of the site alone is liable, which has been referred to and not the one, whose links merely refer to the publication.
 

11. Copyrights, brands and trademarks

The author will make every effort to consider in all publications, copyrights of the used graphics, sound documents, video sequences and texts, to use graphics, sound documents, video sequences produced by itself, or to revert back to license-free graphics, sound documents, video sequences and texts.

All brands and trademarks, mentioned within the internet offer, which may be registered and protected by third parties, are unrestrictedly subject to the regulations of the respective valid laws and to the rights of the registered owners. However, due to the sole mentioning of a brand or trademark, no conclusion can be drawn, that brand names are not protected by third-party rights!

The copyright for published objects, produced by the author itself, remains exclusively with the author of the pages. Reproduction or use of such graphics, sound documents, video sequences and texts in other electronic or printed publications shall not be allowed without the author’s express consent.
 

12. Place of jurisdiction, place of fulfilment and governing law

Place of fulfillment for deliveries, services and payments is the registered office of the Bödmen-Baad Ski School in the municipality of Mittelberg/Kleinwalsertal.

The court at the registered office of the Bödmen-Baad Ski School is the sole court for all disputes arising from this contract. Austrian Law applies. The contract language is German.
 

13. Legal force:

If individual provisions of these terms and conditions of business should be or become invalid, the validity of the remaining provisions and of the legal transaction as a whole is not thereby affected. The invalid provision shall be replaced by a provision, which comes closest in law to the economic purpose of the invalid provision.
